Description
- The Diário da República is the official journal of Portugal, pursuant to Article 119 of the Constitution of the Republic.
- The electronic edition of the Diário da República is legally binding (since 1 July 2006) and the
publication of the acts performed through it is valid for all legal purposes, in accordance with paragraph 5 of article 1 of Law No.
74/98 of November 11, amended and republished by Law No. 43/2014, of July 11.
- The Diário da República is exclusively edited by electronic means on the Internet website https://dre.pt/ managed and made available by the National Printing Office and
Mint, as a public service of universal and free access to all its contents and functionalities, under the terms
of Decree-Law No. 83/2016.
Functionalities
The website of the Diário da República includes, inter alia, the following
functionalities:
- The legal text of the acts that need to be published in the Diário da República, pursuant to the Constitution and law, namely Law No. 74/98, of November 11, amended and
republished by Law No. 43/2014, of July 11; (the legal acts published in the 1st series of the Diário da
República are available since 1910, the legal acts published in the 2nd series of the Diário da
República are available since 1980 and the corporate acts published in the extinct 3rd series of the
Diário da República are available between 1943 and 30 June 2006, in https://dre.pt/).
- Explanatory summaries of decree-laws and regulatory decrees in plain language in Portuguese and English.
- An updated consultation tool of the consolidated text, without legal value, of the relevant legislation of the
legal order (1030 legal regimes have already been consolidated).
- Repository of royal legislation (from 1603 to 1910) through
the webservice for Parliament.
- A legal translator tool of terms.
- A search tool, through descriptors of terms, of acts that need
publication in the Diário da República.
- Legal information duly treated and
systematized by the DIGEST team of the Presidency of the Council of
Ministers.
- Interconnection with sectoral bases of complementary legal information, namely jurisprudence: https://dre.pt/emissores-jurisprudencia, http://www.dgsi.pt/, https://dre.pt/tribunais-superiores,
community law and administrative guidelines.
- Identification and links to electronic websites of other official journals of Member States of the European

Legal framework on the publication of legal acts in the Diário da República
- The official journal Diário da República comprises the first (1st) and second (2nd) series, in
accordance with Article 3 (1) of Law No.
43/2014 (publication, identification and form of legal acts to be published in the official journal) and
Article 5 (1) of Decree-Law No.
83/2016 (approves the public service of universal and free access to the official journal).
- Article 119 (1) of the Constitution of
the Portuguese Republic and Articles 3 (2) and 8 (1) of Law No. 43/2014 determine which
typology of legal acts have to be published in the 1st series of the official journal.
- Article 3 (2) (h) and (i) of Law No.
43/2014 and Article 119 (1) (g) of the Constitution
of the Portuguese Republic determine the typology of official judicial announcements and the typology of
judgments of the courts which have to be published in the 1st series of the official journal.

- The European Legislation Identifier (ELI) is applied to all types of acts published in the 1st series of the
Diário da República from 2 January 1991.
- Article 3 (3) of Law No 43/2014, Article 5 (3) of Decree-Law No. 83/2016 and Articles 6 (2), 7 (1), 10 (1) and
13 (1) (a) and 2 (b) of Legislative Order No. 15/2016 (Regulation
of the Publication of Acts in the Diário da República) determine the typology of official
governmental announcements, the typology of official judicial announcements and the typology of judgments of the
courts which have to be published in the 2nd series of the Diário da República.

- The lack of publicity of legal acts in the Official Journal implies its legal inefficiency, in accordance with
article 119 (2) and (3) of the Constitution of the Republic and with article 158 (2) of the Code of Administrative Procedure.
